Commercial and Financial Law

The doctoral study programme as a third-level study programme focuses on the acquisition of knowledge based on the current state of scientific knowledge and, in particular, on the student's own contribution to it, which is the result of scientific research and independent creative activity in the field of science.



Prospects of graduates

The graduate of the study programme Commercial and Financial Law has an up-to-date overview in the field of scientific methodology within the field, theory of commercial law, theory of financial and tax law and related legal and economic disciplines, has the competence to develop the acquired knowledge, scientifically justify it, analyze partial areas, draw conclusions and scientifically generalize. At the same time, he/she is familiar with the mechanism of linking national commercial law, financial law and related legal disciplines with the relevant European Union documents.

Because the graduate of the study programme is proficient in the methodology of the field and can independently and creatively use and develop the acquired knowledge, he/she can hold a position as a qualified researcher and can be employed in research teams at university, academic and other educational and research institutions, as well as in leading positions in the field of science management, economic and financial policy, tax and fiscal policy and related policy areas.

Also, a graduate of this study programme is eligible to teach mainly in law faculties as well as in faculties/universities providing education mainly in the field of commercial law, financial law and tax law.

The graduate of the doctoral studies in the study programme Business and Financial Law is qualified to perform analytical, expert, forecasting and conceptual tasks of a worker at a higher management level in the organisational structure of central and local state administration, mainly in the field of legislation

The graduate of the study programme Commercial and Financial Law has a wide range of opportunities for the application of his/her knowledge and expertise in commercial law, financial law and related legal disciplines also in the international area, especially as an employee of European, international and national institutions operating in the field of tax policy coordination and cooperation in tax administration, as an employee in the banking bodies of national and international institutions or in the legal and tax department of multinational companies.

Last but not least, a graduate of the doctoral study programme in Commercial and Financial Law can also be employed as an advisor to the Constitutional Court of the Slovak Republic, as a chief state counsellor at the Ministry of Finance of the Slovak Republic, and as a tax advisor to the Ministry of Finance of the Slovak Republic. at the Ministry of Economy of the Slovak Republic, an employee of domestic judicial authorities applying commercial and financial law in the preparation of documents for decision-making, but also in legal professions with a focus on commercial and financial law and related legal disciplines - attorney, judge, tax advisor, assistant at the Supreme Administrative Court of the Slovak Republic, etc.

Conditions of admission

1.

In addition to passing the entrance examination, the admission requirements are:

- completion of a second-level university degree in law,

- completion of a second-level university degree in law,

- completion of a second-level university degree in law,

- knowledge of at least one world language.

The ranking of candidates will be determined by the examination board according to the results of the entrance examination separately for full-time and part-time studies. The minimum condition for passing the entrance examination is obtaining a majority of points for all parts of the entrance examination, i.e. a minimum of 101 points. In the event of equality of scores between several applicants, the committee will determine the order taking into account the extent and quality of the applicants' professional publications and the results of their other professional activities.

The dean of the faculty decides on the admission of applicants to the study within 30 days from the verification of the fulfilment of the conditions of admission to the study. Applicants will be admitted to the study in the order of the total number of points achieved in the admission procedure within the planned capacity of study programmes in individual forms of study. The number of applicants admitted to full-time doctoral studies depends on the economic possibilities of financing scholarships for doctoral students at the Faculty of Law of the University of Pavol Jozef Šafárik in Košice in a given academic year. Within the study programmes in the field of law, the faculty plans to admit an expected number of 10 doctoral students in the full-time form of study and an expected number of 10 doctoral students in the part-time form of study.

The decision on the result of the admission procedure will be sent to applicants according to the provisions of Section 58(7) of the Higher Education Act. In the admission decision, the Dean of the Faculty shall indicate the name of the supervisor and the topic of the dissertation, as well as the ranking position in which the applicant has been placed. The decision not to admit the applicant shall also contain information on the ranking position in which the applicant was placed.

An applicant may submit an application for review of the decision on the result of the admission procedure pursuant to the provisions of Section 58(8) of the Higher Education Act.



Form of entrance exam

1.

Admission examination in individual study programmes consists of:

a) an assessment of the framework project on the dissertation topic,

b) an oral examination.

2.

Evaluation of the framework project on the dissertation topic:

The basis for this part of the entrance examination is the framework project on the topic of the dissertation submitted by the candidate together with the application for studies. The project will be evaluated by the dissertation supervisor before the date of the entrance examination; the applicant may obtain a maximum of 100 points for the dissertation project.

3.

Oral examination consists of:

a) oral part consisting of a presentation of the framework project for the dissertation and answering questions in a discussion on the elaborated framework project on the topic of the dissertation, which may also include a test of the ability to communicate in a foreign language; for this part of the entrance examination the candidate may obtain a maximum of 50 points,

b) oral part of the oral part in the field of the chosen study programme: the candidate shall draw two questions from the range of questions in the fields of the chosen study programme and answer them orally; for the oral part of the entrance examination in the field of the chosen study programme the candidate may obtain a maximum of 50 points.
